Welcome to Elevator. These Terms of Service ("Terms") are a legal agreement between you and JoinElevator LLC ("Elevator," "we," "us," or "our"). They govern your access to and use of the Elevator platform at joinelevator.io (the "Platform"), including all features, content, and services.

By creating an account or using the Platform, you agree to these Terms. If you do not agree, do not use Elevator.

1. Eligibility

You must be at least 16 years old to use Elevator. By creating an account, you represent that you are at least 16 years of age and that you have the legal capacity to enter into these Terms. If you are creating an account on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

2. Account Registration

To use most features of the Platform, you must create an account with a valid email address and password. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. If you believe your account has been compromised, contact us immediately at support@joinelevator.io.

Elevator accounts are for individual use. Candidates may not share accounts, and employer team members should each have their own account within their organization.

3. How Elevator Works

Elevator is a two-sided hiring platform that connects candidates with employers through video pitches, intentional expressions of interest, and live recorded interview rounds.

Candidates create profiles, record video pitches, browse job postings, and express interest in roles. Candidates are limited to 10 expressions of interest per day to encourage intentional applications.

Employers create organizations, post job listings, review candidate pitches, manage a hiring pipeline, and conduct Live Round interviews.

AI matching powers the Platform's candidate-to-job recommendations using profile and job posting data. AI is also used to parse job descriptions submitted by employers.

Elevator is not an employer, a staffing agency, or a recruiter. We do not make hiring decisions, guarantee employment, or guarantee that any candidate will be considered for any particular role. See Section 12 (Employment Disclaimer) for more details.

4. Candidate-Specific Terms

Profiles and Resumes

You are responsible for the accuracy of the information in your profile. Your profile may include your name, job title, skills, experience, role type preferences, location, profile picture, and resume.

Resumes are subject to a 30-day lock period after upload, during which they cannot be replaced. After the lock period expires, you may upload a new resume.

Salary Expectations

Your salary expectations are private. They are used solely by the Platform's matching system to generate salary alignment indicators and are never displayed to employers. Only alignment categories (such as "aligned" or "partially aligned") are visible to employers — never your actual salary figure.

Expressions of Interest

You may express interest in up to 10 job postings per 24-hour period. This limit exists to encourage thoughtful, intentional engagement with roles that genuinely match your interests and qualifications.

Privacy Controls

Elevator offers privacy features including Stealth Mode (hides your profile from your current employer), Ghost Mode (makes you visible only to employers you express interest in), Pitch Blur (applies a full visual blur over your pitch video for employers), and a public sharing toggle. These features are described in detail in our Privacy Policy.

5. Employer-Specific Terms

Organizations and Teams

Employers operate within organizations on the Platform. The person who creates an organization is the organization admin. Team members may be added with designated roles: admin, recruiter, hiring manager, or reviewer. Each role has specific permissions that determine what actions a team member can take within the Platform.

Organization admins are responsible for managing their team membership and ensuring that team members use the Platform in accordance with these Terms.

Job Postings

Employers are responsible for the accuracy of their job postings, including job titles, descriptions, requirements, salary ranges, and role types. Job postings must describe real, currently available positions. Posting fictitious, misleading, or discriminatory job listings is prohibited.

Employers may use the AI-powered job description import feature to parse existing job descriptions. You are responsible for reviewing and verifying the accuracy of any AI-parsed content before publishing.

Hiring Pipeline

Employers manage candidates through a pipeline system. Moving a candidate through pipeline stages, inviting them to Live Rounds, and communicating through the messaging system are all actions taken at the employer's discretion and responsibility.

Candidate Data

Employers may view candidate profile information, pitch videos, Live Round responses, and salary alignment indicators only for candidates who have expressed interest in their posted roles or who appear in their pipeline. Employers may not download, redistribute, or use candidate data or videos outside the Platform except as reasonably necessary for their internal hiring process for the specific role the candidate applied to.

6. Video Content Policy

Video is central to the Elevator experience. The following rules apply to all video content on the Platform, including pitch videos and Live Round responses.

Recording Requirements

All videos must be recorded live within the Platform. Pre-recorded video uploads are not accepted for pitches or Live Round responses. AI-generated avatars, deepfakes, synthetic media, or any form of artificial video representation are strictly prohibited. The person appearing in the video must be the account holder.

Pitch Videos

Pitch videos are short recordings where candidates introduce themselves and present their qualifications. Pitch recordings are subject to a 30-day lock period after recording, during which they cannot be re-recorded. Candidates have up to 5 takes per recording session and a maximum recording length of 90 seconds.

Live Rounds

Live Rounds are recorded interview responses to employer-provided questions. Questions are revealed only when recording begins — candidates cannot preview questions in advance. Live Round responses are recorded live and submitted directly to the employer. Live Rounds expire 72 hours after they are sent if no response is recorded.

Prohibited Video Content

The following content is prohibited in any video on the Platform:

  • Sexually explicit or suggestive content
  • Nudity or partial nudity
  • Hate speech, slurs, or discriminatory language
  • Threats of violence or harassment
  • Content promoting illegal activity
  • Graphic or disturbing imagery
  • Spam or irrelevant content unrelated to professional presentation
  • Content that infringes on the intellectual property rights of others
  • Intentionally misleading or deceptive content about your identity or qualifications

Violation of this video content policy may result in content removal, account suspension, or a permanent ban.

7. Messaging Conduct

The Platform includes a messaging system for communication between candidates and employers. All messages must be professional and relevant to the hiring process. The following are prohibited:

  • Harassment, threats, or abusive language
  • Spam or unsolicited commercial messages
  • Requests for personal contact information for purposes unrelated to hiring
  • Discriminatory language or content
  • Sharing of another user's private information

Messages may be reviewed in connection with content reports and moderation actions.

8. Prohibited Conduct

You agree not to:

  • Use the Platform for any purpose other than legitimate hiring or job seeking activities.
  • Create multiple accounts for the same person.
  • Impersonate another person or misrepresent your identity, qualifications, or affiliation.
  • Scrape, crawl, or use automated means to access the Platform or collect data from it.
  • Attempt to circumvent rate limits, security measures, or access controls.
  • Interfere with the Platform's operation, including introducing malware or attempting to overload systems.
  • Use candidate data, videos, or profile information for any purpose other than evaluating candidates for the specific roles they applied to.
  • Share, sell, or redistribute any user's personal information or video content obtained through the Platform.
  • Post discriminatory job listings or use the Platform to discriminate against candidates on the basis of race, color, religion, sex, national origin, age, disability, genetic information, sexual orientation, gender identity, or any other characteristic protected by applicable law.
  • Use the Platform to facilitate any illegal activity.
  • Attempt to reverse-engineer the AI matching system or manipulate match scores.

9. Content Moderation and Reporting

Elevator maintains a content moderation system to keep the Platform safe. Users can report content or other users through the Platform's reporting mechanism. Reports are reviewed by our moderation team.

Reports are limited to 5 per 24-hour period to prevent abuse of the reporting system. Duplicate reports on the same content are not permitted.

We may take the following actions in response to violations:

  • Content removal: Reported content may be hidden or removed.
  • Warnings: Users may receive warnings for minor or first-time violations.
  • Account suspension: Accounts may be temporarily suspended for serious or repeated violations. Suspended users will be notified by email and will see a suspension notice when attempting to access the Platform.
  • Permanent ban: Accounts may be permanently banned for severe violations. Banned users will be notified by email and will be unable to access the Platform.
  • Reactivation: Suspended accounts may be reactivated at Elevator's discretion after review.

We reserve the right to take moderation action at our sole discretion, with or without prior notice, for any conduct we determine to be harmful to the Platform or its users.

10. Intellectual Property

Elevator's Intellectual Property

The Platform, including its design, features, code, branding, logos, and AI matching technology, is owned by JoinElevator LLC and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Platform without our prior written consent.

Your Content

You retain ownership of the content you create and upload to the Platform, including your profile information, videos, resumes, and messages. By posting content on the Platform, you grant Elevator a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content as necessary to operate and promote the Platform. This includes displaying your pitch video to employers, showing your profile in search results and AI-matched recommendations, and displaying your public profile page if you have enabled public sharing.

You may revoke this license by deleting your content or your account, except where we are required to retain content for legal or safety purposes.

Shareable Profile Pages

If you enable public sharing, your profile page will be accessible at a public URL. This page may be indexed by search engines and shared on social media. You can disable public sharing at any time, which will remove your profile page from public access.

11. Subscriptions and Payments

Certain features of the Platform may require a paid subscription. Subscription tiers, pricing, and included features will be published on the Platform.

12. Employment Disclaimer

Elevator is a technology platform, not an employer, staffing agency, or employment service.

Elevator does not employ any candidates on the Platform. We do not make hiring decisions, extend job offers, set compensation, or control any aspect of the employment relationship between candidates and employers.

We do not guarantee that any candidate will receive expressions of interest, be placed in a hiring pipeline, receive Live Round invitations, or be hired for any position. We do not guarantee that any employer will find suitable candidates or fill any position.

Employers using the Platform are solely responsible for their hiring decisions, including compliance with all applicable employment laws and regulations. Candidates are solely responsible for verifying the legitimacy of employers and job postings.

Elevator does not verify the accuracy of information provided by candidates or employers, including qualifications, work history, company details, or job posting accuracy, except as specifically described in these Terms. While our AI matching system aims to surface relevant matches, match scores and recommendations are not guarantees of suitability or fit.

Any employment relationship formed through the Platform is solely between the candidate and the employer. Elevator is not a party to any employment agreement, contract, or arrangement resulting from use of the Platform.

13. Equal Opportunity Notice

Elevator is committed to providing a platform free from discrimination. We expect all users — both candidates and employers — to comply with all applicable equal employment opportunity laws, including but not limited to:

  • Title VII of the Civil Rights Act of 1964
  • The Americans with Disabilities Act (ADA)
  • The Age Discrimination in Employment Act (ADEA)
  • The Equal Pay Act
  • The Genetic Information Nondiscrimination Act (GINA)
  • Applicable state and local anti-discrimination laws

Employers may not use the Platform to discriminate against candidates on the basis of race, color, religion, sex (including pregnancy, sexual orientation, and gender identity), national origin, age, disability, genetic information, veteran status, or any other characteristic protected by applicable law.

Candidates who believe they have experienced discrimination through the Platform may report it using the Platform's reporting mechanism or by contacting us at support@joinelevator.io.

Elevator reserves the right to remove job postings, suspend accounts, or ban users engaged in discriminatory practices.

14. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Platform will be uninterrupted, error-free, or secure. We do not warrant the accuracy, completeness, or reliability of any content on the Platform, including AI-generated match scores, job descriptions parsed by AI, or user-provided information.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JOINELEVATOR LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID TO ELEVATOR IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

16. Indemnification

You agree to indemnify, defend, and hold harmless JoinElevator LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Platform, your violation of these Terms, your content, or your violation of any rights of another party.

17. Termination

You may delete your account at any time. Upon deletion, your personal data will be handled as described in our Privacy Policy.

We may suspend or terminate your account at any time, with or without cause, and with or without notice. Reasons for termination may include violation of these Terms, harmful conduct, extended inactivity, or any reason at our sole discretion.

Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, and indemnification.

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through a notice on the Platform at least 30 days before the changes take effect. Your continued use of the Platform after the updated Terms take effect constitutes your acceptance of the changes.

If you do not agree to the updated Terms, you must stop using the Platform and delete your account.

19. Governing Law and Disputes

These Terms are governed by the laws of the State of Tennessee, United States, without regard to conflict of law principles.

Any disputes arising out of or related to these Terms or your use of the Platform shall be resolved exclusively in the state or federal courts located in Tennessee. You consent to the personal jurisdiction of these courts.

20. General Provisions

  • Entire Agreement. These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Elevator regarding your use of the Platform.
  • Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
  • Waiver. Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
  • Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
  • Notices. We may send notices to you via email to the address associated with your account or through the Platform's notification system.
